Privacy Policy

1. This document sets out the rules for the processing of personal data collected via the website available at verificators.com (hereinafter referred to as the “Website”).
The entity responsible for operating the Website and administering personal data is:
VERIFICATORS SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Warsaw (02-703), ul. BUKOWIŃSKA 8/212, entered in the Register of Entrepreneurs of the DISTRICT COURT FOR THE CAPITAL CITY OF WARSAW IN WARSAW, XIV ECONOMIC DEPARTMENT OF THE NATIONAL COURT REGISTER under KRS number 0000486125, with share capital of PLN 50,000, NIP: 7962963538, REGON: 146974230, hereinafter referred to as VERIFICATORS Sp. z o.o.
3. Personal data collected by VERIFICATORS Sp. z o.o. via the Website is processed in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, which repealed Directive 95/46/EC – also known as the GDPR.
4. VERIFICATORS Sp. z o.o. attaches great importance to the protection of the privacy of persons using the Website and takes all necessary measures to ensure the security of Users’ data.

§2 Scope of data processed, purposes, and legal basis

  1. VERIFICATORS Sp. z o.o. collects personal data of natural persons who:
    – perform legal actions not directly related to their business activity,
    – conduct business or professional activity as natural persons,
    – represent legal persons or organizational units without legal personality, which have legal capacity under the law.
    In the rest of this document, all these persons are collectively referred to as Users.
    Users’ personal data is collected in particular in the following cases:
    a) when using the contact form available on the Website – for the purpose of performing a contract concluded electronically.
    The legal basis for data processing is the necessity of processing for the performance of the contract for the use of the contact form (Article 6(1)(b) of the GDPR).
    When using the contact form available on the Website, the User may be asked to provide the following data:
    a) e-mail address,
    b) first and last name,
    c) contact telephone number.
  2.  When browsing the Website, the system may automatically collect additional technical data, such as: the IP address of the User’s device or the IP address of the Internet service provider, domain name, type of browser used, time of connection to the website, and type of operating system. The Website may also collect data on User activity on the Website, in particular information on links clicked and other interactions undertaken on the Website.
  3. The legal basis for the processing of this data is the legitimate interest of the controller (Article 6(1)(f) of the GDPR), consisting in improving the functioning of electronic services and increasing their usability.
    In situations related to the pursuit of claims, their enforcement or defense against them, the controller may process selected personal data of the User – such as name, surname, information on the use of services, as well as other data necessary to prove the existence of a claim or determine its scope, including the amount of damage.
    The legal basis for such processing is the legitimate interest of the controller (Article 6(1)(f) of the GDPR), covering both the pursuit of claims and the defense against them before the competent authorities or courts.
  4.  The provision of personal data to VERIFICATORS Sp. z o.o. is voluntary.

§3 Disclosure of personal data and retention period

  1. Users’ personal data may be transferred to entities providing services to VERIFICATORS Sp. z o.o. in connection with the operation of the Website. Depending on contractual arrangements and the nature of the cooperation, these entities may act as:
    – data processors (acting in accordance with the instructions of VERIFICATORS Sp. z o.o.), or
    – data controllers (independently determining the purposes and means of processing personal data).
    a) Data processors – these are companies that process data exclusively on the basis of explicit instructions received from VERIFICATORS Sp. z o.o.. These include, among others, hosting service providers, accounting offices, companies providing tools for internet marketing, website traffic analysis, and measuring the effectiveness of advertising activities.
    b) Data controllers – VERIFICATORS Sp. z o.o. also cooperates with entities that act as independent data controllers, which means that they independently determine the purposes and methods of processing Users’ personal data. This group includes, among others, payment service providers and banking institutions.
  2. Location of data processing – Cooperating entities have their registered offices both in Poland and in countries belonging to the European Economic Area (EEA).
  3. Personal data storage period:
    a) If the processing of personal data is based on the User’s consent, the data will be processed by VERIFICATORS Sp. z o.o. until the consent is withdrawn. After withdrawal of consent, the data may be stored for a period corresponding to the limitation period for any claims – both those that may be asserted by the Company and those that may be asserted against it. In accordance with the regulations, unless otherwise specified, the limitation period is six years, and in the case of periodic claims or claims related to business activity – three years.
    b) When the legal basis for data processing is the conclusion and performance of a contract, the User’s personal data is stored for the period necessary to perform the contract and then, as above, for a period corresponding to the limitation period for claims arising from the contract. The standard limitation periods are six years, and in the case of periodic claims or claims related to business activities – three years, unless separate provisions provide otherwise.
  4. Navigation data may be used to improve the quality of service provided to Users, conduct statistical analyses, tailor the Website to the individual preferences of visitors, and efficiently manage its operation.
  5. In the event of receiving a relevant request or demand, VERIFICATORS Sp. z o.o. may transfer personal data to the competent state authorities. This applies in particular to organisational units of the Public Prosecutor’s Office, the Police, the President of the Personal Data Protection Office, the President of the Office of Competition and Consumer Protection, and the President of the Office of Electronic Communications.

§4 Cookies und IP-Adresse

  1. The Website uses so-called cookies – small files saved on the end device of the person visiting the website by VERIFICATORS Sp. z o.o., provided that the web browser settings allow it. A typical cookie contains the name of the domain from which it originates, its expiry date and a unique, randomly generated identifier. The data collected using cookies enables VERIFICATORS Sp. z o.o. to tailor its offer to the preferences and needs of Users, as well as to compile aggregate statistics on visits and interest in the products presented.
  2. VERIFICATORS Sp. z o.o. uses two types of cookies:
    a) Session cookies – these are stored on the User’s device only until the browser is closed or the computer is turned off. After this time, the information is automatically deleted from the device’s memory. This mechanism does not allow any personal data or other confidential information to be downloaded from the User’s computer.
    b) Persistent cookies – these are stored in the memory of the User’s end device and remain there until they are manually deleted or their validity period expires. This type of cookie does not allow any personal data or other confidential information to be obtained from the User’s device.
  3. VERIFICATORS Sp. z o.o. uses its own cookies for the following purposes:
    a) conducting analyses, research and audits regarding website traffic, including the creation of anonymous statistics illustrating how Users use the Website. The information obtained in this way allows us to optimise the structure and content of the website.
  4. VERIFICATORS Sp. z o.o. also uses cookies from external entities for the following purposes:
    a) promoting the Website via the Facebook.com social media platform (the administrator of these cookies is Facebook Inc. based in the USA or Facebook Ireland based in Ireland);
    b) collecting general, anonymous statistical data using the Google Analytics analytical tool (the administrator of cookies is Google LLC based in the USA);
    c) displaying multimedia content from YouTube on the website (the administrator of cookies is Google Inc. based in the USA).
    d) implementing the newsletter subscription process and its management, including remembering the consents given, the User’s thematic preferences and analysing the effectiveness of e-mail marketing campaigns (including open and click rates). The administrator of these cookies is GetResponseA. based in Gdańsk (Poland), which provides mailing services to VERIFICATORS Sp. z o.o. The newsletter is informative and is sent once or twice a month, covering industry trends and security advice.
  5. The cookie mechanism used on the Website is safe for Users’ devices. It cannot be used to infect a computer with viruses, malware or other unwanted programs. However, the User may restrict or completely block the use of cookies in their browser settings. As a result of such a decision, it will be possible to use the Website, with the exception of functions that require cookies to function properly.
  6. Instructions for changing cookie settings in popular web browsers:
    a) Internet Explorer,
    b) Microsoft EDGE,
    c) Mozilla Firefox,
    d) Chrome oraz Chrome Mobile,
    e) Safari i Safari Mobile,
    f) Opera.
  7. VERIFICATORS Sp. z o.o. may collect Users’ IP addresses. An IP address is a unique number assigned to a device visiting the Website by an Internet service provider, enabling the use of the network. In most cases, it is dynamic, which means that it changes with each connection to the Internet. This data is used, among other things, to diagnose technical problems with the server, prepare statistical analyses (e.g. determining the regions that generate the most traffic on the website), improve the functioning of the website, ensure its security, and identify automated tools that search content in a manner that places an excessive load on the server.
  8. The Website may contain links to external websites. VERIFICATORS Sp. z o.o. is not responsible for the privacy policies applicable to those websites.

§5 Rights of data subjects

  1. Right to withdraw consent – legal basis: Article 7(3) of the GDPR.
    a) The user has the right to withdraw any consent given to VERIFICATORS Sp. z o.o.
    b) Withdrawal of consent takes effect from the moment of withdrawal.
    c) Withdrawal of consent does not affect the lawfulness of data processing carried out prior to that decision.
    d) Withdrawal of consent does not entail any negative consequences for the User, but it may prevent the use of services or functions which, in accordance with the regulations, may only be provided with the User’s consent.
  2. Right to object to data processing – legal basis: Article 21 of the GDPR.
    a) The user may at any time object – for reasons arising from their particular situation – to the processing of their personal data, including profiling, if it is based on the legitimate interest of VERIFICATORS Sp. z o.o.. This applies, among other things, to marketing activities related to the Company’s products and services, statistical analyses of the use of the website’s functionality, improving its operation, and satisfaction surveys.
    b) Opting out of receiving marketing content about products or services by e-mail will be treated as an objection to the processing of personal data – including profiling – for these purposes.
    c) If the objection proves to be justified and VERIFICATORS Sp. z o.o. has no other legal basis for processing the data, the information will be deleted to the extent covered by the objection.
  3. Right to erasure (‘right to be forgotten’) – legal basis: Article 17 of the GDPR.
    a) The user has the right to request the erasure of all or selected personal data.
    b) A request for data deletion may be submitted in particular in situations where:
    a. personal data is no longer necessary for the purposes for which it was collected or processed;
    b. the User has withdrawn their consent, if the processing was based on it;
    c. the User has objected to the processing of their data for marketing purposes;
    d. personal data has been processed unlawfully;
    e. the deletion of data is required in order to comply with an obligation under European Union law or the law of a Member State to which VERIFICATORS Sp. z o.o. is subject;
    f. the data was obtained in connection with the provision of information society services.
    c) Even after a request to delete personal data has been submitted – as a result of an objection or withdrawal of consent – VERIFICATORS Sp. z o.o. may retain selected information to the extent that its further processing is necessary to establish, pursue or defend claims, as well as to fulfil obligations arising from European Union law or national regulations to which the Company is subject. This applies in particular to data such as: first name, last name, e-mail address – stored for the purpose of handling complaints and claims related to the use of VERIFICATORS Sp. z o.o. services – and, in the case of sales or service contracts, also the address of residence/correspondence and order number.
  4. Right to restrict data processing – legal basis: Article 18 of the GDPR.
    a) The User may request the restriction of the processing of their personal data. Until such a request is considered, the use of certain functionalities or services whose operation requires the processing of the data covered by the request will be impossible. During this period, VERIFICATORS Sp. z o.o. will also not send any communications, including marketing communications.
    b) The User has the right to request restriction of processing in particular when:
    a. they question the accuracy of their personal data – in which case VERIFICATORS Sp. z o.o. will restrict its processing for the duration of the verification, but for no longer than 7 days;
    b. the processing is unlawful, but instead of deleting the data, the User requests that its use be restricted;
    c. the personal data is no longer needed by the controller for the purposes for which it was collected, but is needed by the User to establish, pursue or defend claims;
    d. the User has objected to the processing of the data – in which case the restriction applies for the time necessary to assess whether, in the given situation, the protection of the rights, freedoms and interests of the User outweighs the interests of the controller processing the data.
  5. Right of access to data – legal basis: Article 15 of the GDPR.
    a) The user may request the Controller to confirm whether their personal data is being processed. If so, they have the right to:
    a. access their personal data;
    b. receive information concerning: the purpose of processing, the categories of data being processed, the recipients or categories of recipients to whom the data is disclosed, the envisaged period for which the data will be stored (or the criteria used to determine that period, if it cannot be specified), the rights under the GDPR, the possibility of lodging a complaint with a supervisory authority, the source of the data, as well as the rules for automated decision-making, including profiling, and the safeguards applied in the event of data transfer outside the European Union;
    c. receive a copy of their personal data.
  6. Right to rectification – legal basis: Article 16 of the GDPR.
    a) The User may request the Controller to immediately correct their personal data if it is incorrect. Taking into account the purposes of processing, the User also has the right to request that incomplete data be supplemented – including by submitting an additional statement – by sending a relevant request to the e-mail address indicated in §6 of this Privacy Policy.
  7. Right to data portability – legal basis: Article 20 of the GDPR.
    a) The user has the right to receive from the Controller the personal data that they have provided and then transfer it to another controller of their choice. They may also request that the Controller send this data directly to another controller, if technically possible. In such a case, the data will be transferred in a CSV file, which is commonly used, machine-readable and allows for easy transfer of information to another system.
  8. If the User exercises any of the rights described in this Policy, VERIFICATORS Sp. z o.o. will comply with or refuse to comply with the request without undue delay, but no later than within one month of receiving it. If, due to the complexity of the case or the number of requests received, it is not possible to comply within this period, the period may be extended by a maximum of two months. The User will be informed of the extension and the reasons for it within one month of the date of submission of the request.
  9. The User may submit complaints, questions and requests to the Administrator regarding the processing of their personal data and the exercise of their rights
  10. The User has the right to request VERIFICATORS Sp. z o.o. to provide a copy of the standard contractual clauses by sending a relevant request in the manner specified in §6 of this Privacy Policy.
  11. If the User considers that the processing of their data violates the provisions of the GDPR or other laws regarding the protection of personal data, they may lodge a complaint with the President of the Personal Data Protection Office.

 

§6 Changes to the Privacy Policy

  1. The content of this Privacy Policy may be modified, of which VERIFICATORS Sp. z o.o. will inform Users at least 7 days before the changes come into effect.
